摘要
在涉外海员劳动关系中适用冲突法强制规范有助于对外派海员劳动权益给予合理充分的保护。《涉外民事关系法律适用法》及其司法解释中的冲突法强制规范不仅包括中国国内法的强制规定,还包括某些海事国际条约和惯例中的强制规定。要避免冲突法强制规范在涉外海员劳动关系中的扩张适用,明确区分其与公共秩序保留制度的界限,并恰当处理好不同冲突法强制规范同时作用于涉外海员劳动关系导致的规则冲突。
The application of mandatory rules under private international law contributes to the sound and adequate protection of the seafarers in their employment contracts. The mandatory rules under law of the People' s Republic of China on Choice of Law for Foreign - related Civil Relationships and its judicial interpretation include those in both domestic laws and in conventions and international practice. Special efforts should be made so as to avoid the overuse of mandatory rules, the confusion with public order rules, as well as the internal conflicts between different mandatory rules.
