摘要
评估主体是行政强制设定后评估制度中的一个关键性因素,它的建构不仅关乎到评估结果的客观性、公正性以及科学性,而且对于完善行政强制立法具有重要意义。当前我国《行政强制法》中存在评估实施主体设置不统一、公众参与主体形式化严重、没有区分度等问题,因而,进一步完善行政强制设定后评估主体的建构,是促进行政强制评估制度发展的应有之意。
Evaluation subject is a key factor in evaluation system after administrative coercion settings, its construction not only is related to the objectivity, impartiality and scientifieity of evaluation results, but also has important significance for perfecting the administrative compulsory legislation. Currently, there are problems such as evaluation implementation subject settings being disunity, public participant＇s formalization being serious and having no discrimination in China＇s Administrative Compulsory Law, therefore, to further improve the construction of the evaluation subject after administrative arbitrariness settings is necessary to promote the development of administrative compulsory evaluation system.
