摘要
当前我国法院裁判与民意冲突呈现出多发性、易扩散性、后果多重性等特点。兴起于上个世纪五、六十年代的现代社会冲突理论对解决我国法院裁判与民意冲突的启发意义主要体现在以下四个方面:一是全面认知法院裁判与民意冲突产生的原因;二是正确看待法院裁判与民意的冲突;三是选择适当的方式解决法院裁判与民意的冲突;四是构建多元化的法院裁判与民意冲突解决机制。
At present, the judicial judge and the public opinion conflicts presents some characteristics in our country , such as multiplicity, easy diffusivity and consequences. In the last century 50 s and 60 s, The enlightening significance on the modern social conflict theory to solve the judicial judge and the public opinion conflicts can be reflected in the following four aspects, firstly, to comprehensive realize the causes of the court judge and the public opinion conflict; secondly, to have a correct view of the court judge and the public opinion conflict; thirdly, to solve the court judge and the public opinion conflict in an appropriate manner; fourthly, to build a diversified solution mechanism for the judicial judge and the public opinion conflicts.
