摘要
通过对X县人民法院进行集中调研,对离婚损害赔偿案件进行了重点研究。随着物质和经济的不断发展,农村青壮年外出打工增多,夫妻分居,配偶与他人同居,家庭暴力,不良嗜好等现象不断出现。随着离婚率的升高,在案件具体执行中,离婚损害赔偿对于当事人来说难度较大。离婚损害赔偿案件在实务中出现的问题有:1.离婚损害赔偿标准不一,获赔成功率低;2.人口流动过大使得离婚索赔举证困难;3.法院重调解使得离婚损害赔偿的成功率降低。在立法上出现的问题有:1.离婚损害赔偿的举证困难导致合法权益得不到维护;2.离婚损害赔偿的范围过于狭窄;3.我国有关离婚损害赔偿中的精神损害赔偿立法较少。对此笔者提出一些改进建议:首先在实务的角度:1.对无过错一方当事人的取证保护要倾斜;2.赔偿数额的确定要阐明标准;3.合理配置司法资源,最好不要用调解代替审判。其次在立法的角度:1.举证规则要完善;2.加大离婚损害的赔偿范围;3.完善精神损害赔偿。
Through the investigation on People’s Court in X County of Hebei Province, the cases of compensation for divorce damage are studied. With the continuous development of material and economy, more and more rural middle-aged people go out to work, so the couples are separated. It resulted in the bad phenomena of illegal cohabitation, family violence and bad habits. Thus the rate of divorce is increased. It is found that in theimplementation of some specific cases, the divorce damage compensation for the parties is difficult to conduct. There are some problems existing in the cases of divorce damages in practice. First, due to the standards of divorce damage compensation are different, the success rate is low. Second, the high population flow makes it difficult to claim the evidence of divorce damage. Third, that the court emphasizes the mediation causes the lower success rate in compensation. In the legislative problems there are also some problems. First, the legitimate rights and interests cannot beguaranteed due to the difficulties in obtaining the evidences. Second, the scope of divorce damage compensation is too narrow. Third, there is insufficient legislation for mental damage compensation.Based on the above analysis, it puts forward some suggestions for improvement. In the view of practice, it gives the suggestions of protecting the evidence of the innocent party, determining the amount of compensation and collocating reasonably judicial resources to judge instead of mediate.In the legislative perspective, it suggests to perfect the rules of evidence, to enlarge the scope of compensation for divorce damage and to improve the law of mental damage compensation.
