摘要
当代西方哲学发生了语言学转向,这种转向为我们提供了认识实证法的全新视野。作为一种技术和产品,实证法的最大特点在于其创造性,这种创造是语言基础上的创造,语言使实证法创造得以可能。作为一个语言系统,语言内在的秩序奠定了实证法秩序的基础,语言的可解释性消解了法律系统内部的矛盾,赋予了实证法适应复杂现实的充足弹性,而语言的历史性使实证法得以成为一个有生命力的传承系统。
The linguistic shift in the contemporary Western philosophy has provided a brand - new perspective for learning about positive law. As a technology and product, the most distinctive feature of positive law is its crea- tivity. This creativity is based on guistic system, the internal order language , and language makes it possible for positive law to be creative. As a lin- of language counteracts the internal conflicts within legal reality, and the historical nature of language sets basis for order of positive law, the interpretability of language system and renders affluent flexibility for positive law to fit in complex makes positive law a lively succeeding system.
