摘要
《国有土地上房屋征收与补偿条例》的出台,是立法理念和设计模式的转变。然而,由于公共利益界定的模糊、补偿依据的偏差以及救济程序的瑕疵,发挥《国有土地上房屋征收与补偿条例》应然的价值功能仍有不少完善空间。可依正当性原则,在公共利益实质性判断标准的明确、补偿依据从以"建筑物"为中心到以"权益"为本位的转变、被拆迁人权利保护与救济程序的完善等方面进一步提升。
The implementation of State-Owned Land Housing Levy and Compensation Regulation is a turn in legal concept and design pattern. However, due to the vagueness in defining public interests, deviation of compensation basis, and defects of relief process, there is still much room for giving the rein to and perfecting the deserved values of the Regulation. Much can be improved, in accordance with the principle of properness, in making clear the substantial estimation standard of public interests, change from building centered to interest based compensation basis, and the perfection of the right protection of dismantlees and relief process.
