摘要
捆绑式利益团体规模的扩大和战后国家利己主义理论的发展是过急的"政府承认"在国际法实践中不断被运用的原因之一。人道主义在绝对主权的"壁垒"之内的"无效化"决定了过急的"政府承认"违反不干涉内政原则。而承认国做出过急"政府承认"时的主观故意属性和客观干涉效果的取得是其应纳为新干涉主义范畴的重要依据,应在国际法理论中明确过急的"政府承认"的非正义性,并将"有效统治"作为"政府承认"的前置条件。
The expandment of bundled interest groups and postwar National Egoism Theory was one of the reasons that precipitate "Government Recognization"continued to be used in the practice of international law.The "nullification"humanitarian in the absolute sovereignty "barriers"decided that "Government Recognization"violated the Principle of Non-interference in internal affairs .The subjective intent and the objective interference effect that admit country made a hasty property "Government Recognization"pro-vided important basis for its new-interventionism areas .Therefore, precipitate "Government Recogniza-tion"should be clearly definited to be injustice and "effective rule"should be taken as its premise condi-tion in the theory of international law .
