摘要
阐述"的"字短语是法律语言在长期应用的过程中形成的独具特色的组句形式,在现有中国法律法规中极为常见,通常在法律条文中呈现一种假设语境。在借助乔治·库德提出的法律句篇原理及相关法律翻译原则的基础上,从保留假设语境与隐含假设语境两个角度,对合乎标准的"的"字短语的英译作系统的总结,并指出部分译文中存在的问题。
As a unique sentence-building form at shaped in the long-term application of legal language,＆quot;de＆quot;phrases, w hich usually present a hypothetical context, have found their w ide usage in contem porary Chinese legislation. Based on the principle of legislative expression proposed by G eorge Coode and relevant rules of legal translation, a com prehensive and system atic research is conducted into the C-Etranslation of ＆quot;de＆quot;phrases from tw o approaches---reservation and im plication of the hypothetical context, and som e problem s are highlighted in the current English versions as w ell, aim ing to shed certain light on standardizing the translation of legal texts.
