摘要
著作权限制和例外可以为残疾人获取知识和信息提供法律保障。美国、英国和日本的著作权法对图书馆为残疾人服务可适用的著作权例外的内容和途径做出了明确的规定。我国的著作权法及相关法律、法规可以借鉴美国、英国、日本在此方面的先进经验,从以下5个方面进行完善:扩大残疾人的受众范围、增加著作权例外的灵活性、制订图书馆主体资质认定标准、界定著作权例外可适用的版权作品类型及授权图书馆作为为残疾人服务的第三方。
Copyright limitations and exceptions could provide the disabled with the legal protection in acquiring the knowledge and the information. Copyright laws in America, England and Japan have clearly stipulated contents and approaches of copyright exceptions that are applicable to library services for the disabled. The copyright law and related laws and regulations in China should draw lessons from the advanced experience in America, England and Japan, improve in following five aspects： expanding the audience scope of the disabled, increasing the flexibility of copyright exceptions, making the identification standard of the library＇s subject qualification, defining the type of copyright works applicable to copyright exceptions and authorizing the library as the third party which provides services for the disabled.
