摘要
组织功能在技术层面上由组织结构保障。审委会纵横交叉的"十字形"组织结构,决定了它不具有以苏力为代表的社会结构与功能论的解决疑难法律问题、抵御行政干预、提高法官素质等"对法官的功能",但具有降低不确定性风险的组织功能。这种降低风险的方式是以不确定性来应对不确定性,以牺牲司法确定性为代价而获得的,就此而言,审委会是中国法院的一种反司法的制度。
Technically, organization function is guaranteed by organization structure. The cross-shaped organization structure of judicial committee determines that it does not have functions to judges such as the functions of solving difficult legal problems, resisting administrative intervention or improving the quality of judges as professor Su-Li＇ s social structure and function theory holds. But it has organization function of reducing the risk of uncertainty and this way of reducing risk is acquired to the cost of using uncertainty to deal with uncertainty or sacrificing judicial certainty. In this sense, Chinese judicial committee is an anti-judicial system.
