摘要
在我国,检察机关的金融检察建议权主要来源于综合治理的宏观政策和检察实践的微观拓展。基于统计数据、实地访谈、媒体报道等实证素材,实践中的金融检察建议已贯穿各办案环节、种类相对丰富、效果也较为明显。操作流程主要包括"线索发现"、"部门批处"、"实地调研"、"制发文书"、"效果实现"等五个环节,运行效果受"问题意识"、"绩效考核"、"专业视角"、"沟通互动"等潜在因素影响。未来中国金融检察建议若要更大限度地实现综治效果和社会责任,其制发运行需要以质量优化为目标,以问题解决为依归。
In China, the power of the procuracy to give financial recommendations to financial agencies originates from the macro policy of comprehensive governance and the micro operation of prosecutorial practice. Through statistics, field interviews and media report, we found that not only a variety of financial recommendations have been used in almost every case dealing stage, but also the effects are relatively good. The general operational process includes clue finding, approval by director, field research, document making, and effect achieving. These sub processes are affected by some underlying factors. In order to realize the comprehensive adjustment and its social responsibility, its sanctions and operation should take optimizing quality as the target and solving problems as the center.
