摘要
基于法律行为发生的不动产物权变动纠纷虽是司法实务中常见的案件类型,但其在理论观点和裁判意见上却长期存在分歧,既给当事人就诉讼类型和请求的选择带来困惑和误导,也造成法院同案不同判,影响司法的统一和权威。文章从案例分析入手,聚焦于房屋借名买卖法律行为引发的房屋权属确认纠纷之理论争议和司法分歧,进而探寻在我国现行法律框架下解决此类依法律行为发生的不动产物权变动纠纷的现实路径。
The real right change for real estate in the light of legal action is a common case in judi- cial practice, but there are long - time divergences on the theoretical views and judgments concerned, which bring puzzlements and misleading to clients in proceeding types and plead selection, cause discrepancies in the judgment over the same case and affect nega- tively the uniformity and authority of justice. Base on cases, this paper focuses on the purchase of houses using others' names that leads to disputes on ownership in order to search a rational route solving the problem of real right change for real estate according to current Chinese legal framework.
