摘要
实行过限行为是共同犯罪行为中的个人行为,需要将实行过限行为从共同犯罪行为中区分开来。所以,实行过限行为的界定、评定标准、构成要件及其处罚以及在实行过限中其他共同犯罪人的处罚是研究的重点内容。
The behavior of action over limit is the individual behavior in joint crime , which needs to be distinguished from the joint crime.So, the key content of this study is on the definition , evaluation criteria, constitution and punishment of action over limit includes , as well as punishment to the other joint offender in action over limit .
