摘要
医师如实履行告知义务,是患者知情同意权实现的前提和基础。通过对《执业医师法》中医师的告知内容、告知方式、告知对象的同意权顺序以及违反医师告知义务的法律责任等问题进行分析,并提出相应修改建议,以完善医师告知义务制度,从而更好地保护患者的知情同意权。
Physicians＇ obligation to inform is the premise and foundation of the patients＇ informed consent right.This paper analyses the issues such as physicians＇ informed details,informed ways,the informed objects＇ order of exercising the consents,and the legal liability of the physicians violating the obligation in The Licensed Physician Law.And this paper also puts forward the revising suggestions in order to complete physicians＇ obligation to inform,to better protect the patients＇ informed consent right.
