摘要
本文立足农村土地占有和使用关系的“实际” ,揭示了土地承包经营权的质态的多样性和不稳定性 ,前瞻了土地承包经营权的发展趋势 ,指出了土地承包经营权在短期内还很难发展成一项质态稳定的土地权利。认为土地承包经营权立法应坚持一条渐进主义的立法方针。
On the basis of the 'facts' of the relation between rural land holding and usage,this article discloses the variety and unstabilty of the quality of contractuel operation right of rural land and foresees its trend.Then,it points out that it is difficult for it to advance into stability in a short term.We must persist in gradualism in legislation of rural land right until it is separated into stock right and rural land use right as two divisions.
