摘要
依法治国方略的确立 ,使法治模式成为我国未来社会的必然选择。法治模式的内在要素有信仰、原则、制度和规则 :法律信仰是法治模式的灵魂 ,在古代就出现法学家、思想家对法律的信仰 ,但只有融入法治现实的信仰才是法治模式的要素 ;法律原则是法治模式的基石 ,它既是法律信仰的外化 ,又是法律制度、规则建立的基础 ;法律制度是法治模式的构架 ,制度是把信仰、原则与规则联系起来的纽带 ;法律规则作为法治模式的细胞 ,是其他三要素的具体化和载体。只有重视法治模式四要素的建设 ,正确处理它们之间的关系 。
The making of the strategy of ruling the state by law makes the pattern of rule by law be an inevitable choice for the future society of China. The pattern includes four basic elements: creed, principle, system and rule. The legal creed is the core of the pattern of rule by law and it was put faith in by jurists and thinkers in ancient times. Yet it can only be an element of the patterns of rule by law when the faith is rooted in the actual law; The legal principle is the keystone to the pattern of law, incarnate of the legal creed legal, as well as the foundation of the establishment of legal system? The legal system is the framework of the pattern of rule by law and ties up creed, principle and rule? As the 'cell' for the pattern of the legal rule by law, the legal rule mirrors and species the other three elements. Thus only by devoting much attention to the four elements and dealing with one another in a correct way can a law-ruled society be set up.
