摘要
肇始于20世纪70年代末的新闻法学研究到今天已经发展了四十年,随着社会的持续发展,从最初单一的研究问题到现今形成以新闻法治研究为核心主题、其他多个子议题并存的厚重丰富的研究面貌。本文按照研究主题的变迁来对过去四十年新闻传播法学研究进行划分,确定三个发展阶段:由立法需求推动的立法研究阶段(1978-1988),以新闻侵权诉讼案件为中心的理论研究阶段(1989-1999),以舆论监督与网络传播法治为代表的综合性研究阶段(2000-至今)。通过线性梳理,本文试图标识新闻传播法学的代表性研究成果,指出当下研究仍存在的问题,最终探讨新闻法学未来的研究进路。
The study of journalism law, since its inception in the late 1970s, has been developing for forty years. With the continuous progress of the society, it has evolved from the study of one single issue to a full-fledged research on multiple themes centering on the law of journalism. The research has experienced three stages of development, namely the legislative research stage driven by legislative demand(1978-1988), the theoretical research stage centered on news infringement litigation cases(1989-1999), a comprehensive research stage represented by public opinion supervision and law of online communication(2000-present). The author attempts to mark the research achievements of journalism and communication law, find the problems existing in the current research, and explore the future research approach of journalism law.
