摘要
新型支付方式主要指手机、网络等第三方支付方式为代表的支付方式。与传统支付相比这种支付方式的即时性、交易平台的智能性使得这类侵财案件中诈骗与盗窃的适用定性出现较大分歧。两罪可以从行为人与被害者是否有直接的交流沟通,处分财产的意思要否方面进行区分。新型支付方式的本质是以"机器人"作为交易平台,"机器人"在交易中的定位和作用成为案件定性的关键。在网络平台中,金融机构信息管理处账户的转账和信用卡资料数据的读取因为"机器人"的不同属性分别以盗窃罪和诈骗罪论处,虚假的钓鱼网站中侵财行为定性可以根据处分行为的有无进行区别,支付宝平台密码被盗后账户被转账则因为"机器人"能够被骗定性为信用卡诈骗罪,将商家支付二维码替换由于不存在被欺骗后财产处分行为认定为盗窃罪。
The new mode of payment mainly refers to the payment method represented by the three party payment method,such as mobile phones and networks.Compared with the traditional payment,the immediacy and concealment of this kind of payment make the application of fraud and theft in this kind of cases of embezzlement more divergent.The two crimes can be distinguished from whether the perpetrator has direct communication with the victim and whether the intention of disposing of property is necessary.The essence of the new payment method is to use the "robot" as a trading platform,and the positioning and role of the "robot" in the transaction has become the key to the qualitative analysis of the case.In the network platform,the account transfer and credit card data reading of the information management office of the financial institution are different because the different attributes of the robot are punished by theft and fraud respectively,and the qualitative behavior of the illegal phishing website can be classified according to whether or not the disposition act has been stolen or not,and the stolen account of the Alipay platform password.Transferred because the "robot" can be cheated as a credit card fraud,the merchant to pay two-dimensional code replacement because there is no cheated property disposal behavior identified as larceny.
