摘要
人工智能法律系统研究的核心内容是法律推理模拟,这面临两个现实的技术性难题:一是证据推理模拟,在证据分析、社会知识库建构与概括选择等方面遇到困难;二是法律解释模拟,面临着解释的能动性与价值选择的困难。人工智能法律系统的研发目标旨在代替法官或制造机器人法官,但其应用的界限却是不能独立担任法官,这构成一个"旨在代替/不能代替"的悖论,需要在立法限制的同时,实施"人-机系统"解决方案。
The core content of artificial intelligence legal information systems (AILIS) research is the simulation of legal reasoning,which faced two technical challenges:the one problem is the simulation of evidential reasoning,in the analysis of the evidence,constructing the stock of social knowledge and the selection of generalization;another problem is the simulation of legal interpretation with the difficulties of subject activity and value choice.Artificial intelligence legal information system aims to substitute or create a robot judge,but its boundary is that it cannot stand alone as a judge.This poses a paradox of "aimed at replacing/is not a substitute for".It is necessary to keep legislative limitations on the robots serving as judges,and conduct the "manmachine system"solution.
