摘要
在世界各国不断优化反垄断执法机构的改革中,中国三部门反垄断执法机构成立统一独立的反垄断执法部门众望所归。本文从研究探索的角度提出建立更高级别的竞争委员会,制定统一的反垄断执法程序规定,扩大竞争委员会的反垄断执法权力,树立全球的竞争执法意识。同时进行反垄断执法法律制衡制度设计,推行反垄断执法全过程记录制度和建立反垄断行政处罚自由裁量权基准制度,提出建立竞争行政法官制度和竞争法庭(院)的构想,从反垄断行政执法和司法制衡的制度设计角度进行探讨,以期实现《反垄断法》的社会治理目标。
In the reforms of the world’s countries that constantly optimize anti-monopoly law enforcement agencies, China’s three-quarter anti-monopoly law enforcement agencies have established a unified and independent antimonopoly law enforcement agency, which is widely expected. From the perspective of research and exploration, this paper proposes to establish a higher level competition committee, formulate a unified anti-monopoly law enforcement procedure, expand the competition committee’s anti-monopoly law enforcement power, and establish a global sense of competition law enforcement. At the same time, we should design the legal checks and balances system for antimonopoly law enforcement, implement the anti-monopoly law enforcement process record system and establish a discretionary benchmark system for antitrust administrative punishment, propose the idea of establishing a system of competition administrative judges and a competition court(institution), explore from the perspective of system design of anti-monopoly administrative law enforcement and judicial checks and balances in order to achieve the social governance objectives of the Anti-Monopoly Law.
