论商品房预售许可证明对合同效力的影响 被引量:19

The Effect of Advance Sales Permit of Commodity Houses on the Validity of Contract

摘要 房地产开发企业未依照《中华人民共和国城市房地产管理法》第45条第1款第4项的规定向县级以上人民政府房产管理部门办理预售登记,故而未取得商品房预售许可证明,但却从事商品房预售交易,订立商品房预售合同的,该合同并非办理批准手续才生效的合同,而是属于违反了管理性强制性规定的合同,其效力不受违法性影响。县级以上人民政府房产管理部门应当责令开发企业停止预售活动,没收违法所得,还可以并处罚款。《最高人民法院关于审理商品房买卖合同纠纷案件适用法律若干问题的解释》(法释﹝2003﹞7号)第2条的规定应当予以调整。 Suppose real estate developers fail to follow the rule stipulated by clause 4,section 1 of article 45 of Unban Real Estate Administration Law of the People’s Republic of China,conduct an advanced sale of commodity houses and enter into a contract without an advance sales registration made with the real estate administration of the people’s government above the county level,nor with a permit of advance sales of commodity houses,the validity of such contract shall not be affected because of its illegality. Such contract is not the one,the validity of which is subject to approval,but which violates the mandatory provisions on administration. The land administration department of the people’s government above the county level shall order a stop to the sales,confiscate the illegal income and may impose a fine on the conduct thereof. Article 2 of Interpretation of the Supreme People’s Court on the Relevant Issues concerning the Application of Law for Trying Cases on Dispute over Contract for the Sale of Commodity Houses shall be modified.
