摘要
传统民法在中国古代法制中处于弱势地位的原因之一是小商品经济被抑制。本文着重论证了小商品经济在古代社会中所处的状况、被抑制的原因及具体表现，旨在揭示小商品经济的劣势地位对传统民法所造成的深刻影响。
One of the reasons why Chinese traditional civil law had very little status in the field of Chinese legality history was the restrictions on small commodity economy. The thesis deals with the position of such an economy in Chinese traditional society, the cause of being restricted and the forms of its existence, with an attempt to expound on the great influence of the inferiority of small commodity economy on traditional civil law.
