摘要
比较广告的发展和边沿性比较广告的出现,使我国现行的有关法律法规出现滞后的缺陷。区别比较广告和不正当竞争的关系。判断合法比较广告和不正当竞争行为需要遵循三项规则。我国立法应采用允许兼限制原则。
As more and more comparative advertisings grow and frontier comparative advertisings appear, current laws on comparative advertising have defect. Concurrence between infringing comparative advertisings and unfair competition exists. Determining lawful comparative advertising and unfair competition comply with three principles. Laws should adopt the doctrine of permission and restriction.
