摘要
司法的基本功能在于通过严格“适用规则”或“遵循先例”来实现法律 ,伸张社会正义。然而社会现实是千变万化的 ,而法律规则或先例都具有相对的稳定性 ,二者之间不可避免地出现不相适应的矛盾。在这种形势下 ,一种被称之为“衡平”的司法技术发展起来了。虽然与“适用规则”和“遵循先例”相比 ,“衡平”显得似乎并不那么“基本” ,但在司法实践中 ,它却如此重要 ,以至于早在古代就成为东西方社会矫正司法天平的不可缺少的重要技术。
The basic function of judicature is to let social justice prevail through 'the application of rules',or,'going by precedents'.But,since social reality is ever changing,and rules of law or precedents are relatively stable,incompatible contradictions between the two are unavoidable.In view of such situation,a sort of judicial 'balancing' skill has been developed.Though compared to the 'the application of rules' and 'going by precedents' ,'balancing' doesn't seem so 'essential',yet,in judicial practice,it is so important that early in ancient times,it had become a necessary skill to rectify the judicial balance.
