摘要
房地产按揭权的法律性质表现为物权性、价值权性、担保性、特定性和从属性。在此基础上 ,深入分析房地产按揭权与房地产抵押权的区别 。
Right of Mortgage on Real Estate is featured by natures of right over things value,and security,etc.On the basic of such conclusions,the differences are analysized between right of mortgage on real estate and that of hypothecation, and further to prove that mortgage is different from hypothecation.
