摘要
刑事附带民事诉讼中的侵犯人格权的精神损害赔偿制度,在我国立法上一直是一个空白,然而这一制度的确立则有利于保护当事人的合法权益,符合国际上保护人权立法的潮流。因此,在我国刑事附带民事诉讼中确立侵犯人格权的精神损害赔偿制度势在必行。
In the civil procedure attached to the criminal lawsuits, there is a complete lack of compensationsystem for mental injury in tampering with the individual personality. However, the establishment of thissystem is very important to protect the legal rights of the litigant and it is in accordance with the practice of in-ternational lawsuit proceedings to protect human rights. It is inevitable to establish the compensation systemfor mental injury in tampering with the individual personality.
