摘要
我国传统的监狱行刑模式亟待改革,采用以社区刑罚为主的社会化行刑方式成为刑事执行体制改革的方向。行刑社会化符合我国宽严相济形势政策的基本要求,也是对犯罪和刑罚科学化认识的必然要求,体现以人为本的刑事价值理念。基于刑事一体化的研究进路,行刑社会化的实现不仅需要树立革新行刑理念,完善刑事立法和司法,更需要鼓励社会参与罪犯矫治,优化社区行刑机制,拓展刑事执行的社会化空间。
China＇straditional mode of prison execution needs to be reformed and socialization of community punishment is the direction of reform. Socialization of execution meets the basic requirement of China＇s tempering justice with mercy policy and is also the ultimate requirement of scientific view of crimes and penalty, which reflects the criminal value of people orientation. The realization of socialization of execution requires innovating criminal penalty, perfecting criminal legislation and justice, encouraging society to participate in criminal correction, optimizing community correction mechanism and enlarging the social space of criminal execution.
