摘要
受教育权的实现过程就是对知识的学习掌握过程。但现代知识产权制度对权利人私权保护的扩张限制了受教育权的实现。包容性增长理论强调应该提供给社会成员公平参与社会发展的机会,以克服社会排斥现象。建立知识产权利益平衡机制,一方面有助于实现知识产品的价值,另一方面也有助于增强知识信息的流通与共享,进而激发社会创造热情,创造出更多的知识产品,最终实现二者的包容与互动。
The realization of the right to education is a process of learning and mastering knowledge.However,because of extended protection of private rights,modern intellectual property system limits the realization of the right to education.Inclusive growth theory emphasizes the need to provide opportunities for members to participate in social justice and social development in order to overcome social exclusion.Establishing mechanisms to balance the interests of intellectual property rights may help to realize the value of knowledge products on the one hand.On the other hand,it may enhance the flow of information and sharing of knowledge,and thus inspire the community to arouse their creative enthusiasm,create more knowledge products,and ultimately promote the two inclusive and interactive developments.
