摘要
美国有着比较成熟的职业体育劳资法律制度,集体议价合同在美国职业体育劳资法律关系中起着重要的作用。集体议价合同的制定需要遵守一定的程序,集体议价合同的内容包括强制性条款和非强制性条款。强制性条款主要有收入分配、选秀、自由球员、纠纷解决等内容。中国职业体育劳资结构尚不完善,相关法律制度不健全,应该加速推进集体谈判。
The United States has a relatively mature labor legal system in professional sports, with Collective Bargaining Contract playing an important role. Collective Bargaining Contract requires the following of certain procedures. It includes mandatory subjects and permissive subjects. The former includes salary cap, college draft, free agent, standard player contract and dispute settlement. In China, the legal labor legal system in professional sports is not perfect. Application of collective bargaining contract should be promoted.
