摘要
从人民法院推行司法改革的角度看,司法改革所追求的司法独立乃是新形势下加强和改进党的执政能力的新举措。司法改革涉及三个层面:司法体制、司法行政管理制度和审判方式改革,改革的检验标准应立足于公正与效率,改革的中心环节在于释放合议庭的活力,以及构建合议庭独立审判的权责体系:权责内容体系、组织结构体系、运行机制、框定系统,通过对合议庭重新定位所涉及的合议庭成员之间的关系,合议庭与审判长、庭长、审委会的关系重构,定位人民法院推行司法独立最终落实为合议庭一方独立审判。
From perspective of the court in promoting the judicial reform, the pursuit of the judicialindependence is a new measure to strengthen and improve the CPC＇s governance in the new situation.This paper analyses three aspects concerning the judicial reform the reform of the judicial system, judicialadministrative system and trial mode. It points out that the standard of the reform should be based on justiceand efficiency. The central link is to release the collegial panel vitality, and develop an independent collegialpanel responsibility system： responsibility content system, organization structure, operation mechanism, andframe system. The development repositions the collegial panel, which relates to the relationship between themembers of the collegial panel, and between the court and the presiding judge, judge, and judicial committee.The result will ultimately be the independent collegial panel trial.
