摘要
作为一种新型的船舶租赁形式,集装箱箱位租赁以其充分利用船舶箱位资源、降低营运成本等优势迅速占领了市场。集装箱箱位承租人是否属于海事赔偿责任限制的主体,能否享有海事赔偿责任限制这一历史悠久的权利,在航海实践及理论界引起了很大争议。集装箱箱位承租人应当享有海事赔偿责任限制权利。
Compared with the traditional charter parties slot charter meets the necessity of the shipping industry for the fundamental reason that it not only makes utilization of the shipping space effectively and efficiently but also reduces the cost of transportation to a large extent. There has been many disputes around the issue of whether slot charterers are entitled to the limitation of liability. The slot charterer should have the limitation of liability for maritime claims.
