摘要 美国的征收司法实践主要通过"合理市场价值"的计算实现公正补偿。"市价补偿"虽未能反映不动产的特殊价值,但有利于避免过高的谈判成本,其不足可以通过给予额外补偿、建立特殊价值的举证责任规则加以弥补。在各种市价评估方法中,可比较售价法有利于充分利用市价的信息汇集功能,但难点在于选择合理的参照物业;收入折现法可直接反映物业对产权人的使用价值,但难以反映物业的其他潜在用途的收入或价值;重置成本法可间接衡量资产价值,单独运用容易出现偏差,但可作为可比较售价法的必要补充。我国在不动产征收立法和司法过程中,应当加强对补偿标准计算规则的研究和运用。 In the US judicial practice of real estate expropriation compensation, "just compensation" is realized mainly by the calculation of "fair market value" standard. This standard can not necessarily reflect the special value of real estates, but it can avoid high negotiation costs. Its disadvantage could be made up through extra compensation and setting rules for the burden of proof on special values. The comparable sales approach is good at using the function of information collection of market price, but it is hard to choose a suitable object of reference; the income capitalization approach could directly reflect the value in use for the owners, but it is difficult to reflect the value of other potential usage ; the replacement cost approach could e- valuate the value indirectly, which is easy to lead to deviation, but it is a necessary supplement for comparable sales approach. China should pay much attention to the research and application of these approaches in its related judicial practice.
