摘要
刚柔相济、柔性优先是柔性行政方式的一般运用原理,也是现代行政法治发展的应然趋势。但作为行政行为理论中的"新生儿",柔性行政方式面临着理论研究滞后、制度保障缺乏、行为易被异化等问题,亟须被纳入法制化轨道。按照行政法治原则的要求,从重构行政法学体系、革新行政服务观念、坚持法治底线原则、健全相关法律制度等方面提出建议,有利于提高柔性行政方式的法治化水平,形成以人为本、刚柔相济的行政管理和行政法治模式,推进依法治国方略和行政法治原则的贯彻落实。
With the acceleration of the process of democracy a nd the rule of law in administrative areas, the non-authority administrative means plays a much more important rule. However, as a newborn in administrative acts, facing problems existed in the lags in research、inadequate protection of the rights、lack of system guarantee and so on, it should be controlled by lawruled procedure. Suggestions through reconstructing the theories of the science of administrative law、renewing the sense of service、holding on principle of administrative law and perfecting legal regulations and so on are beneficial to expedite the administrative law and provide experience for building service-oriented government in China.
