摘要
宪法的生命在于实施。细心梳理现行的中华人民共和国宪法,我们发现,宪法中有一些条文一直处于或基本处于"沉睡"状态,包括违宪审查的条文;厉行节约、反对浪费的条文;精减国家机关的条文;保护公民批评、申诉、控告、检举权的条文;全国人大常委会审查批准调整国家预算的条文;全国人大常委会决定特赦的条文;全国人大常委会组织特定问题调查委员会的条文;全国人大及其常委会提出质询案的条文;国家各级行政机关实行首长负责制的条文;民族自治区制定自治条例的条文。唤醒这些"沉睡"的宪法条文是全面实施宪法、建设法治国家的重要任务。
The life of constitution lies in implementation. It has been found that a certain number of pro- visions stipulated in constitution has been or basically been ＂deeply sleeping＂ when looking through the cur- rent constitution. Such kind of clauses includes： the provision of unconstitutional review; the clauses about strictly practicing thrift and combating corruption ; the provision of streamlining government organs ; the clauses providing the protection of the civil rights to criticize, appeal, accuse and prosecute; the provision about the responsibility of Standing Committee of NPC for the examining, approving and adjusting the state budget; the clause entitling the Standing Committee of NPC to decide special amnesty; the provision about the Standing Committee organizing the Special Inquiries Committee; tee＇ s right to make proposal for addressing inquiries; the clause stipulates the NPC and its Standing Commit- the provision of implementing the system of chief exec- utive responsibility in various levels of governments. The clause provides the governments in Ethnic Autono- mous regions have the right to enact autonomous regulations. Enlivening these ＂deeply sleeping provision＂ in constitution is central part of fully implementing constitution and constrncting Rechtsstaat.
