摘要
《老子》第38章中的"道、德、仁、义、礼"可演绎为法的"目的价值等级",与之相对应的"意素核"也可作同样的等级排序。排除不同意素,相对应的现代的目的价值的"意素核"也可形成现代法之"目的价值等级":自然法←自由←博爱←正义←功利(自由特指老子式的自由)。在无根的现代性中,此现代的"目的价值等级"可作为法治的整体目的,为现实中无法解决的法律价值冲突提供参考。
Tao,Virtue,Jen,Justice,and Propriety in Chapter 38of Laozi can be interpreted as'purpose value level class system of law',and the corresponding sememe can also be interpreted as the same level class rank.That is to say,the corresponding sememe of modern'value of law'can also be formed as modern'purpose value level class system of law':natural law freedom fraternity justice utilitarian.This modern purpose value level,as the overall purpose of law,can serve as reference for the resolution of practical legal conflicts in the Rootless Modernity.
