摘要
"共和主义"一方面强调个人自由、另一方面又主张个人自由唯有在奉行法治的政治共同体中方有存在和伸展的空间。作为一个正在建设社会主义法治国家、谋求全民共同福祉的共和国,我国法律与政治学界恰应从共和主义传统中汲取思想资源,而不是在个人主义与国家主义的极端立场中各执一端、剑走偏锋。本文试图回到共和宪制的源头,分析和梳理"共和主义鼻祖"西塞罗的宪法与法治理念,以期为共和主义宪法理论在我国的立基提供一片砖瓦。
Republicanism is a political- legal tradition that tries to strike a right balance between individual liberty and common good. The solution is constitutionalism and rule of law. Cicero stands at the origin of this tradition. He famously stated: 'we become slaves of the law so we can enjoy our freedom. 'In this article,the author delineates the contour of Cicero's republican philosophy,highlights his delicate ideas on'mixed constitution',and analyzes his constitutional theory.
