摘要
德国的违宪审查制度对违宪审查的提起主体与审查主体、审查对象和方式等诸多方面都作了较为详尽的规定,因而,德国的违宪审查制度在保障宪法的最高效力、人民的基本权利以及维护政治体制的稳定等方面,发挥了其应有的机能与作用。我国应借鉴德国宪法法院的设置与运作中的有益经验,发展和完善适应我国国情的违宪审查制度。
The German constitutional review system defines the subject, object and way of the acts, so it plays an important role in the protection of supreme legal authority, the guarantee of people＇s basic rights and the stability of the political system. China should learn good experience from the German practice and improve the Chinese constitutional review system.
