摘要
《爱知生物多样性目标》要求生物多样性公约各缔约方在2015年之前,批准加入《生物多样性公约关于获取遗传资源和公正公平分享其利用所产生惠益的名古屋议定书》,并通过建立相关国家立法,与议定书接轨。议定书的最后文本忽略了发展中国家一直呼吁的"遗传资源来源披露制度",而我国对遗传资源的保护,最集中的体现就是专利法规定的遗传资源来源披露制度。随着履约义务的临近,我国在现有制度的基础上如何与议定书接轨是亟待解决的问题。从分析现有制度入手,针对此问题进行论证,提出应尽快建立与遗传资源惠益分享机制与披露制度相配合,并对遗传资源来源披露制度的全球标准和全球惠益分享机制的形成寄予期望。
Members of the Convention on Biological Diversity are required by the Aichi Diversity Targets that the Nagoya protocol should be approved and their national legislation should be consistent with the protocol by 2015. The final document of the Nagoya Protocol does not mention the disclosure of the origin of genetic resources which is called on by most developing countries. However, the protection of genetic resources in our country is mainly embodied in the system of disclosure of origin in patent law. With the approaching of the performance deadline of compliance obligation of CBD, how to connect our present law with the protocol is especially urgent. This paper discuses the problem start with the existing provisions and puts forward the idea of the cooperation between benefit sharing and the system of origin disclosure, as well as hoping for the global standards of origin disclosure and global multilateral benefit- sharing mechanism.
