摘要
自1999年行政復議法頒佈實施以來,全國人大常委會於2013年首次檢查該法的實施情況。統計結果顯示,中國每年受理的行政復議案件數量與行政訴訟的一審案件數量基本持平,部分地方的復議案件還多於一審行政訴訟案件,而多數的行政復議案件涉及土地、房屋拆遷、勞動和社會保障、衛生、城市規劃等與群眾利益密切相關的領域。作為化解行政爭議的第一道防線,國務院在推動行政復議法修改的同時,在實踐中也積極探索建立專業、便民、高效、權威的行政復議體制,整合多頭行政復議辦案機關,部署行政復議委員會試點是其中一項有益探索。本期特選取國務院法制辦公室行政復議司副司長方軍的文章,全面解讀行政復議委員會試點工作開展五年以來的實效及未來走向。
So far, the pilot project of the Administrative Reconsideration Committee has gone through a course of five years. In August 2008, the Legislative Affairs Office of the State Council deployed to carry out the pilot project of the Administrative Reconsideration Committee in order to implement the request of the CPC Central Committee and the State Council for innovating institutional mechanisms of the administrative reconsideration. In the past five years, the pilot project has gradually expanded from the initial eight provinces to 21 provinces, with 434 pilot institutions, nine of which are provincial governments and their departments, accounting for 2.1% of the total number of the pilot institutions; 119 municipal governments and their departments, accounting for 27.4%; 306 county governments and their departments, accounting for 70.5%. Meanwhile, the pilot project has an increasing social impact and has played an increasingly significant role in promoting the work of the administrative reconsideration in the pilot area. At present, it is a critical period for the development of our country's administrative reconsideration, and it is necessary to systematically summarize and review the pilot practice of the Administrative Reconsideration Committee.
