摘要
本文阐述了明星、媒体及公众作为不同主体应享有的权利及承担的义务,并提出保护明星隐私权的立法方案,尤其是对侵犯明星隐私权的构成要件及责任承担形式做了简明的分析,以期平衡明星隐私权与新闻自由和社会公众知情权之间的利益冲突,为我国明星隐私权法律保护制度提出有效的建议。
Seen from the process of human history, the emergency of the right of privacy is a symbol of social civilization and progress. However, with the dramatic improvement on the modem network media technology, the group of stars, who have gained great attention from the media and the public, their privacy suffers from an unprecedented threat. Therefore, how to provide the necessary protection to the star＇s privacy should be an indispensable topic in our country＇s law. In this article, the author respectively elaborates the rights and obligations of stars, news media and the public and puts forward certain legislation suggestions on the protection of stars＇ privacy and particularly makes a concise analysis on the components and legal responsibilities for the infringement on the stars＇ privacy, through which, the author expects, the conflicts of interests between the three rights mentioned above can be balanced and finally to put forward certain practical and effective advice on the legislation protection for stars＇ privacy in our country.
