摘要
模拟法庭作为重要的实践教学模式曾被寄予厚望,被当做"法学院到法院的桥梁"。中国多所高校法学院系网页资料表明,模拟法庭在法学教育中多流于形式,基本是根据预定剧本进行程式化的"表演",其价值并没有实现。在中国教育改革的新阶段,应根据法学教育职业化导向及素质教育的要求,重新审视"实战型"模拟法庭在法律职业教育中的价值,重构其在人才培养体系中的重要地位,并将实战型模拟法庭作为专业必修课,分专业分阶段进行课程设置,完善相应的运行机制,使模拟法庭教学真正成为实现法学教育与法律职业深度衔接的桥梁。
A moot court, as an important mode of practical teaching, once highly praised, has been regarded as ＂a bridge to connect law schools to law courts＂. However, the web data collected from many faculties of law at colleges and universities in China show that the value of moot courts in legal education has not been realized as expected since the courts of such a kind tends to he only a form, which is basi- cally a stylized ＂performance＂ based on its predetermined stage script. In the new stage of China＇s educa- tion reform, the value of ＂practical＂ moot courts in legal professional education should be re-examined and its important position in the talents-cultivating system should be re-factored according to the require- ments of the profession-oriented law education and quality education in order that ＂practical＂ moot courts will be established as a professional compulsory course, which will be implemented at different stages ac- cording to different majors in accompany with bringing its corresponding mechanism of operation into com- pletion, thus law courts＂. making the teaching of ＂practical＂ moot courts ＂a real bridge to deeply link law schools to
