摘要
物质交换理论、信息交换与转移理论和同一认定理论共同构成了物证技术的基础理论。其中,信息交换与转移理论是物质交换理论在刑事犯罪证据领域的延伸,而同一认定理论则是物质交换理论与信息交换与转移理论在物证技术领域内的体现。这三种理论同时又构筑了两种证明方式,即直接证明方式和间接证明方式。深入理解这三种理论及其构建出的两种证明方式,不仅会使我们对物证技术有明晰的逻辑认识,也会对刑事诉讼中证据的收集方式产生积极的影响。
Material exchange theory, information exchange and transfer theory, and identification cognizance theory all together make up the basic theories of material evidence technology. Among them, information exchange and transfer theory is the extension of material exchange theory in the field of criminal evidence, and identification cognizance theory embodies material exchange theory and information exchange and transfer theory in the field of material evidence technology. These three theories constructed two modes of proof, namely, the direct one and the indirect one. Deep understanding of the logical foundation can not only makes us have a clear logical realization of material evidence technology, but also play a positive role in the way to collect evidence in criminal litigation.
