摘要
农地"还权赋能",即在农村土地集体所有权的制度框架下,使物权化的土地产权向农民回归,农民在国家法律规定范围内,具有对土地的转让、租赁、抵押以及继承等财产权利。农地"还权赋能",一方面应尊重经济社会发展的规律,尊重农民的权利诉求与自主选择;另一方面,也要尊重国家的政治现实,尊重各地区存在的差异性和多样性。其基本思路可概括为"农地确权、法律保障、用途管理、有序流转"。
The property rights delineation of rural land, which means to endow the private property rights of land to farmers under the system of collective land ownership. Within the context of national law, the farmers have the property rights of farmland＇s transfer, lease, mortgage, inheritance and so on. The rural land of ＂property rights delineation＂, should on the one hand, respect the law of economic and social development and the rights of the farmers and the independent choice, on the other hand, respect the political reality of the country and the difference and diversity in different places. The basic idea could be summarized as ＂rights of rural land, legal protection, use management and orderly transfer＂.
