摘要
文学中的法律史学研究是"文学中的法律"中较早出现的一个学术研究领域。19世纪末至20世纪初的法学学者们通过对不同时期的文学作品中的法律意象的解读,不仅为法律史学研究提供了更加丰富的素材,而且也提出了文学作品对于法律史学研究的价值的探讨。对文学中的法律史学研究的学术史的分析将有助于反思文学,尤其是历史文学作品对于法律史研究的意义。
Study of legal history in literature is one of the earliest fields of research under the ＆quot;law in literature＆quot;. From late 19th century to early 20th century, by means of interpreting legal images in literary works of different times, legal scholars provided legal history studies with abundant materials and brought about the discussion concerning the value of literary works to legal history as well. Academic researches on legal history in literary works will beneift the retrospection of literature, especially the signiifcance of historical works to legal history.
