摘要
体育权利是公民的一项基本权利,在基本权利的性质上属于受益权。体育权利的性质决定了其实现的特点。体育权利的实现依赖国家的积极给付,根本上取决于国家的经济实力。在国家现有的财政能力和市场经济体制下,体育权利的实现格局不可能是平等化的,而只能是差序化的,只能优先部分人群和部分地区实现体育权利。现阶段限于国家的经济实力,在不可能平等地实现公民体育权利的情况下,我国宪法确定的公民体育权利还不宜在《体育法》中具体化。
Spots right, a fundamental right for citizen, belongs to beneficial rights in character. The features of sports right set the character for it to be accomplished. The realization of sports right depends on nation＇s active support whether it could be accomplished which is decided by national economic capability. Under our recent financial capability and market economic system, implementation pattern of sports rights couldn＇t be equalized, but have to be differentiated that should give priority to part citizen and part areas to accomplish sports rights. Therefore, as this stage is confined to national economic capability, under the circumstance of impossible to accomplish sports rights equally, sports right for citizen confirmed by our national constitution is not suitable to specify in Sports Law.
