摘要
除具备集体土地使用权与房屋所有权外,宅基地上房屋还因处于农业生产、农村经济、农民生活的宏观语境中而在客观上附带着居住权、农田生产保障权益、庭院经济权益、精神层面的情感利益、围合空间之舒适性利益。所有这些权益相互独立,在宅基地上房屋征收中被一并消灭,因此均应获得相应补偿。细分宅基地上房屋各类权利,有助于拓展征收补偿范围、提升征收补偿价值、最大限度地弥补权利主体的损失。
Besides collective land use right and house ownership, the homestead house, closely related to the agricultural production, rural economic and peasant livelihood, has objectively been attached with right of habitation, security right of farmland production, courtyard economic interests, and mental interests such as affection, comfort of enclosure space. Existing severally, these rights should be subject to corresponding compensation when vanishing with homestead house expropriation. Detailed analysis on all kinds of rights of homestead house may contribute to enlargement of expropriation compensation scope, elevation of compensation value, and compensation for loss of holder of rights to maximum extent.
