摘要
人民代表大会是保障人民民主权利的基本渠道,代表履职是人大代表发挥作用的基本途径,人大代表的履职水平关系着我国公民的各项民主权利。因此,提高人大代表的履职质量,是解决当前我国公民政治参与和民主政治建设问题的关键。我国人大代表的职能应包括代表职能、沟通职能和监督职能。但我国人大代表职能发挥得状况却一直不尽如人意。造成人民代表履职不力的主要因素有:我国现行法律对人大代表权利义务规定模糊;人大代表结构失衡;缺乏具体罢免机制。要改善人大代表履职不力的现状应当完善人大代表组成结构,试行代表专职化,积极探索人大代表新职能。
The People＇s Congress is the basic source of guaranteeing people＇s democratic rights. However, the People＇s Congress do not carried out its functions well, especially the people＇s representatives. There are some reasons for this problem, for example, China＇s cmTent law vaguely defines the rights and duties of the people＇s representatives, poor balance of the structure of the people＇s representatives is unreasonable, and ab- sence of recall mechanism. The people＇s representatives should have thine main functions ： representing function, communicating functions and supervising functions. If we want the people＇s representatives to accomplish their responsibility resuhfully, we should improve the structure of the people＇s representatives, begin to experiment full -time representatives, broaden and explore its new functions.
