摘要
《聊斋志异》与《阅微草堂笔记》都反映了司法不公的社会现实。因作者身份地位有别,前者的叙述角度以民为本位,后者则以官为本位;前者感情激愤,后者情怀温厚。以民为本位,冤狱惊人耳目;以官为本位,疑狱费人思量。昭雪冤狱,则寄希望于清官;辨析疑狱,则感叹于狱情之万变。一个批判的是体制,官虎而吏狼,天下乌鸦一般黑;一个思考的是狱情,吏、役与讼师成干扰司法之元凶。
Both Liao Zhai Zhi Yi and Yue Wei Cao Tang Bi Ji reflects the social reality of judicial injustice. However, due to the different status of the authors, the narration of the former takes a people＇ s perspective, while the latter takes an official perspective. The emotion of the former is angry and rageful, the latter is moderate and clement. From the people＇s perspective, the unjust cases are astonishing and shocking; from the officials＇ per- spective, the disputed cases are complicated and tricky. The former places his hope of redressing unjust cases on clear and just officials ; the latter exclaims the complexity when analyzing the suspicious cases. The former criticizes the system and considers evil officials are samely bad all over the world; the latter ponders over the situation of in- dividual cases, ascribing the problems to bad case handlers, corrupt clerks and lawyers.
