摘要
晚清时期的汪荣宝,同时兼职于多个清末核心新政机构,参与了新刑律等重要法典的审议与起草工作,在清季法政界可谓举足轻重。同时,汪氏一生勤于日记,其内容见证了清末新政时期诸多重大事件,为研究清末政坛必不可无之材料。今人通过汪氏日记的记载,再与其他材料相互印证,实际上可以大致厘清新刑律审议、表决直至最后颁布的经过,以及清末立宪时期立法与行政机关之间的博弈关系。
During the New Deal in the late Qing dynasty ,Wang Rong-bao had played a very important role in political-legal circle by holding posts in the multiple core New Deal agencies in the mean time and was involved in the deliberations and the drafting of the many laws such as New Criminal Code ,in Qing Law politicians scene .Meanwhile ,Wang wrote diary in his life diligently and its contents witnessed many major events in Late Qing period .The diary are absolutely nec-essary for the study of the late Qing Dynasty political arena .By Wang’s diary records and confirmed with other materials each other ,we actually can be roughly clarifying the process of New Criminal code from deliberation ,vote until to final promulgation ,as well as game relationship between the legislative and executive authorities .
