摘要
《旅游法》主要通过规定旅游经营者的违约责任来维护旅游者的合法权益。旅游经营者如未按照法律或旅游合同约定履行义务,或不适当履行义务,致使其实际提供的旅游服务偏离约定的品质或不具备通常的价值,则其应向旅游者承担违约责任。旅游者应根据旅游经营者的违约时点、违约形态以及具体的违约情形选择合适的救济方式。
Tourist Law regulates the infringement duty of the proprietor to protect the legal right of the tourist. If the proprietor disobeys the law or the duty in the tourist contract, or carries the duty improperly which makes the service deviate the set quality or the usual value, he should shoulder the infringement duty for the tourist. The tourist should choose proper relief method according the time, place, and way of infringement or specific violation situation of the infringement.
